Żaden akt prawny nie daje całościowej odpowiedzi na pytanie dotyczące recyklingu elektronicznych i elektrycznych części pojazdów samochodowych. Tymczasem dyrektywy europejskie nakładają na państwa członkowskie (od 2006 r.) obowiązek zbiórki złomu elektronicznego i elektrycznego w wysokości 4 kg na mieszkańca.

Sejm RP 21 listopada 2008 r. przyjął ustawę o zmianie ustawy o zużytym sprzęcie elektrycznym i elektronicznym oraz o zmianie innych ustaw (DzU 2008 nr 223, poz. 1464). Regulacja wzbudziła wiele kontrowersji i przyczyniła się do zaangażowania się branży w prace przy jej projekcie. Nowela obowiązuje od 1 stycznia 2009 r., stąd też poproszono o opinie na temat zawartych w niej zmian.

Dzień przed wejściem w życie ustawy o zużytym sprzęcie elektrycznym i elektronicznym odbyła się konferencja szkoleniowa, na której prawnicy jednego z organizatorów nie pozostawili suchej nitki ani na ustawie, ani na systemie. Wykazali wiele nieścisłości i brak konsekwencji w nowej ustawie. W kuluarach można było usłyszć opinie o następnym bublu legislacyjnym zrobionym przez resort środowiska.
Osławiona dyrektywa 2002/96/WE z 27 stycznia 2003 r. zagościła już na stałe w polskiej świadomości i została w naszym kraju wdrożona w zniekształconej wersji zwanej ustawą z 29 lipca 2005 r. o zużytym sprzęcie elektrycznym i elektronicznym. Nakłada ona wiele obowiązków na wszystkich uczestniczących w cyklu życia sprzętu elektrycznego lub elektronicznego. Niektóre z nich są bardziej uciążliwe od innych.
Po wielu perturbacjach weszła w życie ustawa o zużytym sprzęcie elektrycznym i elektronicznym. Pierwotnie artykuł miał być polemiką z Jerzym Ziają z OIGR, który we wrześniowym numerze "Recyklingu" umieścił rekordową ilość mylnych opinii, ale ostatecznie nakreślony zostanie pozytywny plan przyszłego działania producentów AGD i elektroniki.
Pod koniec lipca została przyjęta ostateczna wersja ustawy o zużytym sprzęcie elektrycznym i elektronicznym. Transponuje ona do prawa krajowego wymagania UE zawarte w dyrektywie 2002/96/WE z 27 stycznia 2003 r. Ustawa określa wymagania, jakim powinien odpowiadać sprzęt elektryczny i elektroniczny oraz zasady postępowania z zużytym sprzętem w celu ograniczenia ilości odpadów.
