Przedsiębiorcy uczestniczący w systemie gospodarowania zużytym sprzętem elektrycznym i elektronicznym są zobowiązani do sporządzania określonych dla danego rodzaju działalności sprawozdań. Następnie powinny być one przesyłane do głównego inspektora ochrony środowiska w terminach wyznaczonych w ustawie.
W ostatnich tygodniach na stronach internetowych Ministerstwa Środowiska pojawiło się sprawozdanie z realizacji Krajowego Planu Gospodarki odpadami. Przy tej okazji sprawozdania pojawiła się również nowa koncepcja systemu gospodarki odpadami w Polsce - czyli to, co nas wszystkich bardzo interesuje.
Jednym ze źródeł finansowania gospodarki odpadami, zgodnym z nowoczesnymi tendencjami rozszerzonej odpowiedzialności przemysłu za zanieczyszczanie środowiska i z zasadą "zanieczyszczający płaci", miała być sławetna ustawa o obowiązkach przedsiębiorców. Po jej wejściu w życie rozpoczął się boom gospodarczy, który charakteryzował się tworzeniem ogromnych ilości organizacji odzysku.
Polski system gospodarki odpadami opakowaniowymi funkcjonuje na obecnych zasadach od 2002 r. Wtedy weszły w życie dwie ustawy z 11 maja 2001 r., transponujące do polskiego prawa dyrektywę UE z 1994 r. w sprawie opakowań i odpadów opakowaniowych, a mianowicie ustawa o obowiązkach przedsiębiorców oraz ustawa o opakowaniach i odpadach opakowaniowych.
Ustawa o zmianie ustawy o obowiązkach przedsiębiorców w zakresie gospodarowania niektórymi odpadami oraz o opłacie produktowej i opłacie depozytowej (Dz.U. Nr 33, poz. 291) została uchwalona przez Sejm 21 stycznia 2005 r., a weszła w życie 1 kwietnia 2005 r. (art. 2 ustawy nowelizującej).
