Na stronach internetowych Ministerstwa Środowiska 15 października 2008 r. został opublikowany projekt ustawy z 13 października 2008 r. po tytułem „Projekt ustawy o gospodarce opakowaniami i odpadami opakowaniowymi”. Ustawa ta ma zastąpić 1 stycznia 2010 r. dwa podstawowe akty prawne, regulujące gospodarowanie opakowaniami i odpadami opakowaniowymi.
Przepisy dotyczące postępowania z opakowaniami i odpadami opakowaniowymi, które obowiązują w Polsce od ponad pięciu lat, ciągle budzą wiele kontrowersji. Można wskazać wiele przyczyn takiej sytuacji, z pewnością jednak należą do nich nieprecyzyjne przepisy oraz różne ich interpretacje.
W związku z wyczerpaniem się w pewnym sensie, możliwości dalszego rozwoju systemów zbiorczych dla recyklingu surowców wtórnych, wiele miast staje wobec problemu usprawnienia tego systemu. W dalszym ciągu w licznych przypadkach odpady opakowaniowe trafiają do kosza razem z odpadami komunalnymi.
Produkty chemiczne przechowywane są w pojemnikach, z którymi nie istnieje możliwość zajścia reakcji chemicznej. Rozpatrując możliwości gospodarowania odpadami opakowaniowymi po produktach chemicznych, należy sięgnąć do karty charakterystyki substancji znajdującej się wewnątrz opakowania.
