Nie ustaje dyskusja na temat potrzeby ujednolicenia w skali kraju zasad selektywnej zbiórki odpadów komunalnych. Zarzewiem sporu stał się wprowadzony 1 lutego 2015 r. art. 4a wielokrotnie nowelizowanej ustawy o utrzymaniu czystości i porządku w gminach.
W wyrokach NSA krystalizuje się linia orzecznicza, zgodnie z którą uszkodzony pojazd może być uznany za odpad wówczas, gdy nie nadaje się do użytkowania w dotychczasowy sposób.
Kompleksowa nowelizacja ustawy o odpadach, uchwalona przez Sejm w styczniu br., przyniosła radykalne zmiany również w zakresie recyklingu pojazdów wycofanych z eksploatacji.
Ostatnia znacząca nowelizacja Ustawy z 27 kwietnia 2001 r. o odpadach uchwalona została w 2005 r. Od tego czasu nastąpiły jedynie mniejsze zmiany w jej treści. Były one przeważnie konsekwencją wejścia w życie innych ustaw.
Wojewódzki Inspektor Ochrony Środowiska w wyniku przeprowadzonej kontroli w jednej z firm zakwestionował roczne sprawozdanie o pojazdach wycofanych z eksploatacji. Zobowiązał prowadzącego działalność gospodarczą, aby przedmioty wyposażenia i części pochodzące z wyremontowanych pojazdów traktować jako odpady i tak ujmować w sprawozdaniach.
Szereg spotkań, konferencji czy wypowiedzi dowodzi, że istnieje duża koalicja na rzecz zwalczania zjawisk patologicznych w branżach odpadowych. Przeciwko sprzecznym z prawem działaniom zgodnie wypowiadają się przedstawiciele biznesu, politycy oraz urzędnicy każdego szczebla.
Zagadnienie transgranicznego przemieszczania odpadów jest regulowane w Ustawie z 29 czerwca 2007 r. o międzynarodowym przemieszczaniu odpadów. Poza tym również w Rozporządzeniu (WE) 1013/2006 Parlamentu Europejskiego i Rady z 14 czerwca 2006 r. w sprawie przemieszczania odpadów.
Pod koniec ubiegłego roku Ministerstwo Środowiska rozpoczęło prace nad projektem ustawy o obowiązkach przedsiębiorców w zakresie gospodarowania niektórymi odpadami oraz o opłacie produktowej i opłacie depozytowej.
Wzrastające lawinowo w Polsce zużycie opakowań, będące odzwierciedleniem sytuacji światowej, spowodowało podjęcie w ostatnich latach stosownych działań ze strony ustawodawcy. Jednym z nich było dostosowanie naszego prawa do wymagań unijnych, w tym do Dyrektywy Rady i Parlamentu Europejskiego 94/62/WE w sprawie opakowań i odpadów opakowaniowych.
W związku z wprowadzoną w Polsce odpowiedzialnością przedsiębiorców za odpady opakowaniowe pojawiło się wiele wątpliwości związanych z interpretacją pojęcia "opakowanie" oraz ustaleniem ich masy podlegającej obowiązkowi odzysku i recyklingu. Ułatwieniem w rozwiązywaniu takich problemów mogą być definicje zawarte w aktach prawnych oraz normatywnych, przywołane w poniższym tekście.
Artykuł 3 ust. 1 Dyrektywy Parlamentu Europejskiego i Rady 94/62 o opakowaniach i odpadach opakowaniowych musi być interpretowany w ten sposób, iż plastikowe torebki wydawane konsumentom w punktach sprzedaży, niezależnie od tego, czy odpłatnie, czy też nie, stanowią opakowania w jego rozumieniu. Orzeczenie w tej sprawie wydał 29 kwietnia 2004 r. (sygnatura C-341/01) Europejski Trybunał Sprawiedliwości.

"Makulatura - odpad czy surowiec?", w którym zawarto dwa skrajne stanowiska w tej sprawie, świetnie odzwierciedla dyskusję, która toczy się również na poziomie Unii Europejskiej w związku z planowaną nowelizacją tzw. dyrektywy ramowej o odpadach (75/442/EWG).
Omawianie teraz zapisów prawa na temat Planów Gospodarki Odpadami (PGO), po ponad dwóch latach od uchwalenia ustawy o odpadach i pod koniec dozwolonego prawem okresu na uchwalenie powiatowych PGO, byłoby wręcz niestosowne.
