Harnleiterverletzungen sind bei der Begutachtung von Behandlungsfehlervorwürfen nach gynäkologischen Eingriffen weiterhin ein aktuelles Problem. Daher wurde das Thema erneut aufgegriffen und hierbei ein Vergleich mit den eigenen früheren Daten der Gutachterkommission Nordrhein sowie mit den Zahlen und Fehlerarten der Norddeutschen Schlichtungsstelle vorgenommen. Von insgesamt 13.322 nordrheinischen Begutachtungsfällen der Jahre 2006–2014 betrafen 95 Verfahren (0,7 %) iatrogene Harnleiterverletzungen in der Frauenheilkunde. Bei der Norddeutschen Schlichtungsstelle waren es 0,5 % von 31.504 Verfahren der Jahre 2000–2011. Der Anteil von Ureterläsionen durch operationstechnische Fehler von Frauenärzten an den 919 nordrheinischen Verfahren in der Frauenheilkunde betrug 2,2 % und lag damit doppelt so hoch wie bei der Norddeutschen Schlichtungsstelle mit 1,1 % von 2892 Verfahren. In 95 nordrheinischen Verfahren wurden 35 vorwerfbare Behandlungsfehler festgestellt, davon 32 bei Frauenärzten (BF-Quote 34 %) und 3 bei Urologen. Die Behandlungsfehlerquote der Frauenärzte lag damit deutlich unter der aus Norddeutschland berichteten Fehlerquote von 47 %, bedingt durch eine dort höhere Anzahl von Fehlern bei der Nachsorge.
Am häufigsten waren mit 70 von 95 Verfahren, d. h. in 74 %, in Nordrhein Harnleiterverletzungen nach Hysterektomien zur Überprüfung gelangt; in 13 von 70 Fällen (19 %) wurden operationstechnische und 12-mal (17 %) nur Fehler bei der Nachsorge festgestellt. Knapp zwei Drittel der überprüften 95 Eingriffe waren ausschließlich/mit Unterstützung der Endoskopie durchgeführt worden; hiernach stellten die Gutachter in 14 der 59 Fälle (24 %) operationstechnische Fehler fest. In den 26 Eingriffen, bei denen auch Adhäsiolysen erfolgt waren, lagen 9-mal (35 %) operationstechnische Fehler vor. Alle 95 Eingriffe waren unter stationären Bedingungen durchgeführt worden.
Bei den 20 operationstechnischen Fehlern wurde als häufigster Einzelfehler 10-mal die trotz erschwerter Bedingungen fehlende Darstellung/Beachtung der Harnleiter festgestellt, darunter 6 Eingriffe, in denen der Ureter im Operationsbericht nicht einmal erwähnt wurde.
Aufgrund der Erkenntnisse der Begutachtungsverfahren sollte zur Abwendung von Harnleiterläsionen das besondere Verletzungsrisiko beachtet werden mit sichernder Darstellung bei erschwerten Gegebenheiten, rechtzeitiger Konversion zur besseren Übersicht und guter, zeitnaher Dokumentation. Handlungsanweisungen zur Nachsorge und zur Entfernung eingelegter Schienen gemäß der Leitlinie der DGGG [3] sollten berücksichtigt werden.
