Wesentlichen Einfluss auf den Ausgang eines Arzthaftungsprozess hat die Frage, welche Partei die Beweislast trägt. Die Partei, die die Beweislast trägt und den Beweis nicht erbringen kann, verliert den Prozess. Besondere Bedeutung kommt in diesem Zusammenhang dem Befunderhebungsfehler zu. Verletzt der Arzt die Pflicht, medizinisch zweifelsfrei gebotene Befunde zu erheben und zu sichern, so kann dies zu einer Umkehr der Beweislast führen. Die Rechtsprechung differenziert zwischen dem Befunderhebungsfehler als einfachem und als grobem Behandlungsfehler und der Pflicht, die Befunde zu sichern und aufzubewahren. Darüber hinaus ist die Befunderhebungspflicht von der Diagnosepflicht zu unterscheiden.
Im neuen Patientenrechtegesetz wird die Beweislast gesetzlich geregelt. Danach muss auch weiterhin grundsätzlich der Patient nachweisen, dass der Arzt einen Fehler gemacht hat und dass dieser ursächlich für den Schaden war.
