Die Fahrerin eines Geländewagens verursacht einen Unfall, in dessen Verlauf sie zahlreiche parkende Pkw streift und erheblich beschädigt. Sie kann flüchten und wird ca. 2 Stunden später von der Polizei zu Hause angetroffen. Zum Alkoholkonsum befragt gibt sie an, dass sie vor dem Unfall keine alkoholischen Getränke, danach aber aus Angst vor dem Ehemann als Besitzer des nagelneuen und teuren Fahrzeugs Obstler getrunken habe. Das Ergebnis einer Begleitstoffanalyse stützt den kurzfristig vor der Blutentnahme erfolgten Konsum dieses begleitstoffreichen Getränks. Eine vom Gericht nachträglich angeordnete toxikologische Analyse der Restblutprobe führte jedoch zum Nachweis hoher Konzentrationen des Benzodiazepins Lorazepam, das vor dem Unfall eingenommen wurde und unfallursächlich war.
