Artykuł przedstawia aktualne orzecznictwo sądów administracyjnych dotyczące statusu prawnego komisji lekarskich Agencji Bezpieczeństwa Wewnętrznego oraz charakteru prawnego wydawanych przez nie orzeczeń w postępowaniu o ustalenie zdolności do służby. Zgodnie z ugruntowaną linią orzeczniczą w przypadku takich postępowań komisje lekarskie Agencji Bezpieczeństwa Wewnętrznego należy uznać za organy administracji publicznej, a wydawane przez nie orzeczenia – za decyzje administracyjne. W artykule zwrócono też uwagę na to, że uznanie komisji lekarskich ABW w postępowaniu o ustalenie zdolności do służby za organ administracji publicznej, a wydawane przez nie orzeczenia za decyzje administracyjne, przesądza o możliwości złożenia skargi na takie orzeczenie do sądu administracyjnego.
The article presents the current judicial decision of administrative courts concerning the legal status of medical boards of the Internal Security Agency and the legal character of the issued statements in the proceedings to determine an ability to service. According to the established judicial line, in the above-mentioned proceedings medical boards of the Internal Security Agency are supposed to be considered as public administrative organs and the issued statements as an administrative decisions. In the article it is also noticed that the recognition of medical boards of the Internal Security Agency as public administrative organs in the proceedings to determine the ability to service, and the boards’ issued statements as administrative decisions determines the possibility to submit a complaint against the statement to the administrative court.
