Odliczanie darowizn na cele kultu religijnego oraz na kościelną działalność charytatywno-opiekuńczą od podstawy opodatkowania podatkiem dochodowym od lat budzi poważne spory doktrynalne. Istotne rozbieżności są widoczne również w praktyce organów podatkowych i orzecznictwie sądów administracyjnych. Przyczyną tej sytuacji jest nieprecyzyjne zredagowanie przepisów zwartych zarówno w ustawach podatkowych, jak i ustawach kościelnych. W artykule dokonano wykładni wspomnianych przepisów, w toku której uwzględniono orzecznictwo sądów administracyjnych oraz dokonywane przez organy podatkowe interpretacje prawa podatkowego. Zgłoszono także postulaty de lege lata pod adresem administracji podatkowej, zwłaszcza Ministra Finansów.
Deduction of donations for religious worship and for the church’s charitable and welfare activity from the income tax base has been arousing doctrinal controversy for many years. Also the approaches of the tax authority and administrative courts reveal vast disparities. The underlying cause seems to be inaccurate phrasing of rules and regulations contained in both tax legislation and in ecclesiastical statutes. The article discusses the relevant regulations and highlights the decisions of administrative courts and interpretations of tax law by the tax authority. Moreover, the author makes de lege lata recommendations for tax administration, in particular for the Finance Minister.
