Ustawa z 27 kwietnia 2001 r. o odpadach traktowała tzw. masy ziemne i skalne w sposób szczególny. Zasadniczo nie stanowiły one odpadu, choć w pewnych okolicznościach postanowienia tej regulacji znajdowały wobec nich zastosowanie. Rodziło to szereg problemów. Sporne mogło być m.in. zagadnienie opłat za składowanie (uregulowane w Ustawie z 27 kwietnia 2001 r. Prawo ochrony środowiska). Generalnie jednak rozwiązanie polegało na wyłączeniu konieczności analizy definicji odpadu.
