Opakowanie towaru pełni wiele funkcji. Z punktu widzenia transportu jedną z najważniejszych jest funkcja ochronna, polegająca na zabezpieczeniu ładunku przed uszkodzeniami lub utratą. W artykule omówiono kwestie dotyczące opakowania towaru i jego przygotowania do przewozu w świetle międzynarodowych warunków ubezpieczeniowych. Wyjaśniono różnice w tym obszarze występujące między Institute Cargo Clauses z roku 1982 i 2009. Sprecyzowano pojęcie"właściwego opakowania" oraz poddano interpretacji sformułowania, które pojawiły się w najnowszej wersji klauzul, jak np. "niezależnego podwykonawcy". Ponadto, wyjaśniono inne, skomplikowane zależności ubezpieczeniowe jak np. kwestie uznawalności opakowania za integralną część towaru jako przedmiotu ubezpieczenia.
Packaging serves a range of purposes. From transportation point of view, one of the most important roles of packaging is a protection from loss of or damage to the cargo. This paper elaborates on a number of issues concerning packaging, as well as the preparation of cargo to the carriage in the context of the international insurance provisions. It also explains some differences in this area between Institute Cargo Clauses from the year 1982 and 2009. The meaning of “suitable packing” has been redefined and some new meanings of the newest clauses edition (e.g. independent contractor) has been interpreted. Moreover, the paper clarifies some complex insurance issues as, for example, recognizing the packaging as an integral part of the cargo as a subject-matter insured.
