Ustawa o zamówieniach publicznych (DzU z 2002 r. nr 72, poz. 664 z późn. zm.) obliguje ogłaszających przetargi do zawierania umów na maksymalny okres trzech lat. Z pewnością jest to zasada słuszna, w przypadku dokonywania zakupów czy usług nie związanych z bieżącym i nieprzerwanym obowiązkiem ich świadczenia. Ułomność tej zasady ujawnia się jednak w przypadku przeprowadzania przetargów na świadczenie prac o charakterze użyteczności publicznej.
