This text examines what the law can do faced with sufferings at work. To begin, we shall present a legal arsenal that doctors and legal experts dispose of to respond to requests from consulting employees. This arsenal includes prevention measures that are at the expense of the employer. He has an obligation to ensure security and health to his employees. He also has to implement prevention measures at the expense of the employees and personnel representatives. They have a right to alert and retrieval. They must denounce facts susceptible to harm the mental health of work colleagues. The occupational doctor has a mission to avoid all harm to the health of employees. The work inspector can record all cases of non compliance to the law. If penal sanctions focus on repression of infractions, the civil sanctions tend to protect the employee subtracting him from the pathogenic work environment and bring him, when possible, the recognition of his suffering under the labels of “work accident” or “professional illness”. Secondly, an evaluation of the efficiency of this legal arsenal will be proposed with the help of a lawyer specialised in work laws. After noting the inefficiency of prevention measures, the author examines the limits of legal action means. He concludes that the layoff for inability, pronounced by the occupational doctor, is the most satisfying solution. It enables legal specialists to establish that this inability is the result of a faulty behaviour on the employer's behalf and obtain remedies and damages for the employees. To prove what he advances, the employee can refer to certificates, as well as ask a bailiff that the content of emails and SMS on his cell phone are taken into account. He can also use audio recordings and videos made without the knowledge of the person under certain limited conditions. However, it is mostly the medical certificate that is the essential part of the folder. The occupational doctor has to rigorously stick to a description of the degradation of the employee's health. It will then be up to the lawyer to prove what is the cause of this degradation. The lawyer will have to eventually rely the occupational doctor testimony on the pathogenic characteristics of the work environment in which the employee was evolving in.
Ce texte examine ce que peut la loi face à la souffrance au travail en deux temps. Pour commencer, il présente l’arsenal juridique dont les juristes et les médecins disposent afin de répondre aux demandes des salariés qui les consultent. Cet arsenal comporte des mesures de prévention à la charge de l’employeur, qui doit la santé et la sécurité à ses salariés, et des mesures de prévention à la charge des salariés et des représentants du personnel, qui ont un droit d’alerte et de retrait et doivent dénoncer les faits susceptibles de porter atteinte à la santé mentale de collègues de travail. Le médecin du travail a pour mission d’éviter toute atteinte à la santé des salariés, tandis que l’inspecteur du travail pourra dresser un procès-verbal en cas de non-respect de la loi. Si les sanctions pénales visent la répression des infractions, les sanctions civiles tendent à protéger le salarié en le soustrayant au milieu de travail pathogène et à lui apporter quand c’est possible la reconnaissance de sa souffrance sous la forme de l’accident du travail ou de la maladie professionnelle. Dans un deuxième temps, une évaluation de l’efficacité de cet arsenal juridique sera proposée, à l’aune de la pratique d’un avocat spécialisé en droit du travail. Après avoir constaté l’inefficacité des moyens de prévention, l’auteur examine les limites des moyens d’action juridiques, concluant que le licenciement pour inaptitude, prononcé par le médecin du travail, est la solution la plus satisfaisante, car elle permet aux juristes d’établir que cette inaptitude résulte du comportement fautif de l’employeur et d’obtenir des dommages et intérêts pour le salarié. Pour apporter des preuves de ses dires, le salarié pourra recourir aux attestations, demander qu’un huissier constate le contenu – mails et SMS – de son téléphone portable, utiliser des enregistrements audio et vidéo réalisés à l’insu de la personne, mais dans certaines conditions limitatives. Mais c’est surtout le certificat médical qui constitue une pièce essentielle du dossier, pourvu qu’il s’en tienne strictement à la description de la dégradation de l’état de santé du salarié. Il incombera ensuite spécifiquement à l’avocat de prouver à quoi est due cette dégradation, en s’appuyant éventuellement sur les constats opérés par le médecin du travail concernant le caractère pathogène du milieu de travail dans lequel évolue le salarié.
